These general terms and conditions (‘GTC’) apply to all services offered by Heiwa Solution SA (hereinafter ‘the Host’), a Swiss public limited company with its registered office in Crans-Montana. The term ‘Tenant’ refers to any person who has made a booking. Any booking implies full and unconditional acceptance of these terms and conditions.

1.Application and scope

These Terms and Conditions apply to all bookings made via the heiwa-house.com website or through any other channel operated by the Accommodation Provider. They govern the contractual relationship between the Accommodation Provider and the Tenant regarding the temporary provision of furnished accommodation in Switzerland.

Any conflicting or additional terms and conditions put forward by the Tenant shall be deemed null and void, unless expressly agreed to in writing by the Host.

2.Booking and conclusion of the contract

  1. The accommodation on offer constitutes an invitation to treat. The Tenant makes their booking request online by selecting their dates and the number of guests, and by completing the form.
  2. The contract is formed upon written confirmation from the Accommodation Provider, following verification of final availability and acceptance of payment.
  3. The Accommodation Provider reserves the right to refuse any booking that is manifestly abusive, suspicious or does not comply with these Terms and Conditions. In such cases, the full payment will be refunded within 48 hours.

3.Use of the property

  1. Private use: the accommodation is intended exclusively for private residential use. Subletting and any transfer to a third party are strictly prohibited.
  2. Commercial use prohibited: any commercial use (filming, photo shoots, events, hosting clients, etc.) is strictly prohibited. Failure to comply will result in the immediate termination of the stay without refund.
  3. Capacity: Occupancy is strictly limited to the number of people specified at the time of booking. Failure to comply will result in immediate termination without refund and an additional charge for any undeclared guests.
  4. Peace and quiet: parties and noisy events are strictly prohibited. The Tenant undertakes to respect the neighbours’ peace and quiet, in particular by keeping the noise down from 10.00 pm.
  5. Smoking: smoking is strictly prohibited inside the property. Failure to comply will result in specific cleaning charges being applied (from CHF 300).
  6. Pets: pets are only permitted with the Host’s express authorisation at the time of booking.
  7. Liability: The Host accepts no liability for theft, loss or accidents occurring within the property. The Tenant must be covered by personal third-party liability insurance.

4.Prices, payment and taxes

  1. Prices are quoted in Swiss francs (CHF), inclusive of all taxes (including Swiss VAT where applicable). Prices may vary depending on the season, length of stay and demand (dynamic pricing).
  2. Tourist tax: this is compulsory and is added to the price in accordance with the applicable local rates (Crans-Montana and surrounding area). It is calculated per adult and per taxable child, per night.
  3. Full payment is required at the time of booking to guarantee access to the accommodation. Payments are processed securely via our service provider Stripe (PCI-DSS Level 1).
  4. The Host will issue a personalised invoice, sent by email after the stay, upon request.

5.Deposit and registration

  1. Online registration via our booking platform is compulsory prior to arrival: identity verification, signing of the contract and payment of the security deposit.
  2. The security deposit takes the form of a bank pre-authorisation (between 200 and 1,500 CHF depending on the accommodation). It will be released after departure provided no damage is found.
  3. Any damage noted on departure that exceeds the amount of the security deposit will be charged in full to the Tenant, based on a detailed quote. Before-and-after photos can be provided on request.

6.Cancellations and changes

Unless specific conditions are stated at the time of booking (non-refundable rates, special offers), the following rules apply:

  • More than 30 days before arrival: free cancellation, full refund.
  • Between 14 and 29 days before arrival: 50 per cent refund.
  • Less than 14 days before arrival: no refund.
  • No-show or early departure: no refund.

Changes to dates are possible subject to availability and payment of any difference in price. Only one free change is permitted per booking.

Right of withdrawal: in accordance with Article 40b of the Swiss Code of Obligations, the right of withdrawal does not apply to short-term tenancy agreements for tourist purposes. The Tenant is informed of this exception at the time of booking.

7.Arrival and departure

  1. Check-in: from 5.00 pm. Earlier check-in may be available on request, subject to availability.
  2. Check-out: by 11.00. Any unauthorised late check-out will be charged at CHF 50 per hour or part thereof.
  3. The Tenant will receive their access instructions (code, smart key, etc.) once online check-in has been completed and no later than 24 hours before arrival.

8.Immediate termination

The Host may terminate the contract with immediate effect and without refund in the event of:

  • dangerous, aggressive or disrespectful behaviour;
  • serious or repeated noise disturbances despite warnings;
  • unauthorised commercial use;
  • occupancy exceeding the declared capacity;
  • the presence of undeclared pets;
  • smoking inside the accommodation;
  • making false statements at the time of booking;
  • any behaviour contrary to these Terms and Conditions or to Swiss law.

9.Force majeure

No party shall be held liable for any breach of its obligations in the event of force majeure as defined under Swiss law (natural disasters, pandemics, administrative closures, acts of terrorism, general strikes, etc.). In the event of force majeure rendering the stay impossible, the Accommodation Provider undertakes to offer a postponement or an equivalent credit note, at no additional cost.

10.Data protection

The processing of the Tenant’s personal data is governed by our privacy policy, which complies with the Swiss Data Protection Act (LPD) and the GDPR.

11.Complaints and mediation

Any complaint must be submitted in writing to contact@heiwa-house.com within 30 days of departure. The Accommodation Provider will endeavour to respond within 15 working days and to propose an amicable solution.

In the event of a persistent disagreement, the parties may seek mediation through the Swiss Tourism Ombudsman before taking any legal action.

12.Changes to the Terms and Conditions

The Host reserves the right to amend these Terms and Conditions at any time. The applicable terms and conditions are those in force on the date of booking. New versions are published on this page along with their update date.

13.Governing law and jurisdiction

These Terms and Conditions and any contract concluded pursuant to them shall be governed by Swiss law, to the exclusion of conflict-of-laws rules.

The exclusive place of jurisdiction is Sierre (Valais, Switzerland), subject to the mandatory provisions of the law applicable to European consumers.
